TERMS AND CONDITIONS OF THE “GYMPAD” MOBILE APPLICATION

Version: 2026-10-09. Last updated: 9 October 2026.

1. Service Provider and scope

The Service Provider is MatCode Mateusz Arczyński, ul. Portowa 10, 86-200 Chełmno, Poland, Polish tax number (NIP) 875-156-25-99, REGON 383604557. Contact, complaints and reports concerning GymPad: matcode.help@gmail.com. These Terms govern the GymPad application and the digital services provided through it.

These Terms are available free of charge before a contract is concluded and can be saved or printed. The account contract is concluded when an account is created after these Terms have been made available and accepted. Conditions for paid access are also presented before purchase. Installing the application alone does not make a purchase or start a paid subscription.

No provision limits rights under mandatory law, particularly consumer rights. The rights in Chapters 4, 5a and 5b of the Polish Consumer Rights Act also apply to an individual entering into a contract connected with their business where the contract is not professional in nature for that individual, under Article 7aa of that Act. The relevant Polish Civil Code protections against unfair contract terms also apply to such individuals. Choosing the Trainer role does not by itself remove those protections.

2. Features and technical requirements

GymPad helps organise and record workouts, plans, exercises, personal records, goals, body measurements, supplement schedules and intake logs. Depending on the version and package, it offers statistics, calculations, training suggestions, artificial intelligence (AI), mobility exercises, Trainer collaboration, coaching messages and replies, session scheduling, and integrations with a watch and the device’s health platforms. The application displays the detailed scope of the offer.

The current version requires Android 8.0 or later or iOS 17.0 or later, a compatible device and storage space. The store description also specifies requirements for the particular version and supported accessories. Accounts, synchronisation, purchases, coaching messages and online features require an Internet connection; some local features may work offline. Integrations require appropriate permissions and compatible software. Device and data charges follow the User’s agreements with their providers.

System modifications, including rooting or jailbreaking, can interfere with operation and security. The Service Provider is responsible for conformity with the contract under applicable law; any lack of conformity caused solely by the User’s incompatible environment is assessed under those rules.

3. Accounts, age and security

The application is intended for people aged 16 or older. A minor uses it and enters into contracts with their legal representative’s consent to the extent required by law. A Trainer providing paid services to others must have the required contractual capacity and meet the obligations applicable to their activity.

Users must provide accurate information required for their account, protect access to it and keep login credentials private. Suspected unauthorised access should be reported to the Service Provider. Users must not bypass security, limits or payments, create accounts to obtain the same introductory offer repeatedly, disrupt the service or obtain other people’s data without a lawful basis.

Accepting these Terms is not consent to advertising, tracking, processing health data or sharing data with a Trainer. The legal bases for processing and separate consents are described in the Privacy Policy.

4. Safe exercise, calculations and AI

GymPad is a tool for organising activity and keeping personal records. It does not provide medical, physiotherapy or dietary services; results, reminders, suggestions and AI content are not a diagnosis, prescription, individual medical advice or an assessment of fitness to exercise. The Service Provider does not guarantee particular training outcomes, weight loss, improved health or freedom from injury.

Exercise and load selection require an assessment of personal abilities and proper technique. Consult an appropriate professional before starting or substantially changing a programme, especially with a medical condition, injury, pregnancy or contraindication to exercise. Do not perform painful exercises or exceed safe limits; stop exercising and obtain appropriate help if concerning symptoms occur. The application and coaching messages are not emergency services or channels for urgent assistance.

Calculations and predictions, such as estimated maximum load, fatigue or progress, are approximations based on input data and calculation methods. AI may produce incorrect, incomplete or unsuitable answers and does not replace professional supervision. Check the safety and suitability of a plan, suggestion, load or exercise change before applying it; a prediction must not be treated as an instruction to attempt a maximum lift.

Supplement schedules reflect the User’s settings; they do not recommend taking a product or prescribe a dose. Check dosage, contraindications and interactions with a doctor or pharmacist and the manufacturer’s information. Notifications depend on factors including operating system settings, battery and permissions, so they should not be relied upon for treatment or other actions requiring a reliable reminder.

This description of the application’s intended use does not exclude liability that cannot lawfully be excluded or the obligation to provide a service conforming to the contract.

5. Licence and User content

The User receives a non-exclusive licence to use the application for its intended purpose, in accordance with these Terms and the applicable store rules, for the contract’s duration. Users must not distribute the application’s code or protected materials without permission, infringe intellectual property rights or remove security controls. These restrictions do not exclude activities permitted by mandatory law, including statutory software and interoperability exceptions.

Rights to personal records, plans, messages and materials remain with the User or other rights holders. The User must be entitled to enter and share that content. The User grants the Service Provider a non-exclusive right to store, technically process and display it only as necessary to provide the selected services, including delivery to the selected Trainer or recipient. Public Trainer profiles are displayed according to their visibility settings. This permission neither transfers ownership nor constitutes consent to use personal data for other purposes.

For an application downloaded from the App Store, the licence identified on its store page also applies. If no separate licence is specified, this is the Apple Standard End User License Agreement. These Terms additionally govern GymPad services subject to applicable store rules and User rights.

6. Free access, introductory access and packages

GymPad offers free access (Standard), paid Premium features and Trainer packages named Starter, Pro and Studio. The application and purchase offer disclose a package’s scope, limits, duration and price before purchase. Limits may concern plans, custom exercises, goals, AI features and the Trainer’s client count. The offer accepted at purchase determines entitlements during the paid period; technical configuration or a later price list cannot arbitrarily reduce them.

A new eligible account receives 14 days of free introductory Premium access. This promotion requires no subscription purchase and does not renew for a charge. It reverts to Standard afterwards unless the User makes a purchase. Recreating an account does not guarantee another introductory period. A separate trial linked to a store subscription purchase, if available, follows the conditions and renewal information shown before purchase.

When paid or introductory access expires, some features and the ability to add or edit items above a limit may be restricted. Expiry alone does not automatically delete saved workouts and plans. Deleting an entry yourself may be irreversible; retain any needed information before deletion. The Privacy Policy explains account deletion and data retention.

7. Purchases, renewals and cancellation

Available purchases are processed through Google Play or the App Store. Before confirming a purchase, the User receives information about the full price, access period, included features, any automatic renewal and trial conditions. The applicable store’s documents also identify the seller and the entity collecting payment.

Disable renewal in the subscription settings of the store used for purchase: Google Play or App Store. The application also provides access to subscription management. Observe the cancellation deadline specified by the store. Ordinary cancellation of renewal leaves access available until the paid period ends and does not itself refund that period. Statutory withdrawal, price reduction and refund rights remain unaffected.

Uninstalling the application, signing out, deleting an account or ending a Trainer relationship does not cancel a store subscription. Before deleting an account, separately disable renewal if you do not want further charges. Price and renewal condition changes require appropriate notice and consent where required by law or store rules; they do not retrospectively change an already purchased period.

Access is granted after the transaction is confirmed by the store and verification system. If delayed or unsuccessful, use the available purchase restore or checking feature or report the problem with the transaction identifier. Do not send passwords or full card details. A valid refund or payment reversal may revoke the corresponding access but does not remove the right to complain or obtain a lawful refund.

8. Withdrawal and refunds

A consumer and an individual protected by Article 7aa of the Polish Consumer Rights Act may withdraw from a distance contract within 14 days of its conclusion where statutory withdrawal rights apply. Send an unambiguous statement before the deadline to matcode.help@gmail.com or the Service Provider’s address in section 1. The applicable store’s procedure may also be used; it neither replaces nor restricts statutory rights against the responsible trader.

Starting to use an ongoing digital service, such as time-limited Premium access, does not by itself remove the right of withdrawal. If the User expressly requested early performance of a paid service and was properly informed, withdrawal may require payment proportionate to the part already performed. The withdrawal right for a service can expire after full performance only where the statutory conditions are met.

For paid digital content not supplied on a physical medium, withdrawal rights can be lost only if all legal conditions are met, including prior express consent to start performance, information about the loss of the right, acknowledgement of that loss and delivery of contract confirmation on a durable medium. Accepting these Terms, purchasing or opening the application does not replace those statements or confirmation. We do not assume that every store checkout automatically obtains them.

A refund following valid withdrawal is made without undue delay and within 14 days of receiving the statement, generally using the same payment method and without refund fees. Where the store processes payment, it participates in the settlement. A store’s voluntary refund policy may provide additional rights but does not exclude statutory complaints concerning non-delivery or lack of conformity with the contract.

Optional example statement: “I withdraw from the contract for [package/service name], concluded on [date]. Name: […], address: […], account email or order number: […], statement date: […]”. A signature is required only for a paper statement.

9. Trainers and client relationships

GymPad provides tools for Trainer profiles, discovery, inquiries, invitations, selected data sharing, plan assignment, workout reviews, coaching messages and session organisation. The Service Provider is not a party to the coaching contract between a Trainer and client, does not set coaching fees and does not collect them on the Trainer’s behalf. The Trainer package fee concerns GymPad tools and is separate from coaching fees.

Trainers are responsible for their qualifications, profile accuracy, lawful activity, advice, plans and client obligations, including price information, complaints, safety and lawful use of shared data. Before collaborating, a client should agree conditions with the Trainer, check qualifications and choose which data to share. Ending a relationship in the application does not automatically terminate a separate coaching contract or settle payments between them.

A “verified” badge, if displayed, is assigned by GymPad rather than self-declared by the Trainer. It is not confirmation of medical authorisation, certification of professional qualifications or a guarantee of service quality or safety. Users should not infer a scope of verification that GymPad has not expressly described.

Search includes visible profiles with active Trainer access, filtered by the selected country and optionally city; paid access is a condition of directory inclusion. The current technical ordering uses the Trainer access expiry date in ascending order and is not a qualification ranking or endorsement by the Service Provider. The limitation concerning independent Trainer services does not cover the Service Provider’s own conduct or duties imposed on it by law.

10. Prohibited content and reports

Unlawful content, threats, harassment, fraud, impersonation, spam, infringement of others’ rights and disclosure of others’ data without a lawful basis are prohibited. These rules apply to public profiles, messages, plans and other shared materials. The Service Provider may restrict visibility, remove content or restrict an account where necessary and proportionate to an established breach, in accordance with section 14 and applicable law.

Report content or abuse to matcode.help@gmail.com. Reports should identify the exact content or location (for example, a profile, conversation participants and message date), explain why it is unlawful or breaches these Terms, provide the reporting person’s contact details and confirm their good-faith belief that the information is accurate and complete. Identifying details are not required where applicable law provides an exception.

Where contact details are available, the Service Provider acknowledges receipt, assesses the report without undue delay, diligently and objectively, and communicates the outcome. Reports and appeals are reviewed by a person; these Terms do not establish automatic moderation of every message. When content causes a restriction, the User receives reasons explaining its basis, scope and how to challenge the decision, unless law prohibits disclosure of particular information. A free request for reconsideration may be sent to the same address, without excluding other legal remedies. The Service Provider also acts on binding orders from competent authorities.

11. Personal data, external services and saving information

The Privacy Policy explains data categories, purposes, legal bases, recipients, retention and User rights. Trainer data sharing, health integrations and features requiring consent follow the separate controls and requirements described there. Users should enter only information needed for the selected feature and exercise care when including health information in messages or text fields.

The application uses infrastructure, authentication, diagnostics, AI, advertising and payment providers identified in the Privacy Policy. Store, carrier and integration terms apply to services provided directly by those entities. This does not transfer the Service Provider’s consumer obligations to the User or exclude responsibility for providers used to perform the Service Provider’s own contract.

Synchronisation may take time and require a connection. Before signing out, changing devices or uninstalling, check that information has been saved and retain important information through available features or request a copy of data. This recommendation does not exclude the Service Provider’s obligations concerning security, data access or conformity with the contract.

12. Complaints and conformity with the contract

Report issues with operation, purchases, access or contractual performance to the email in section 1. It helps to provide the account email, problem description, application and system versions, event date and requested remedy; omitting this information does not remove complaint rights. The Service Provider responds to consumer complaints within 14 days of receipt on a durable medium, such as email. Where applicable law provides that consequence, failure to respond within the deadline constitutes acceptance of the complaint.

The Service Provider is responsible for delivery and conformity of digital content or services with the contract, including necessary updates. Consumers and individuals covered by Article 7aa may use statutory remedies: requesting delivery or conformity and, where the legal conditions apply, a price reduction or withdrawal with a refund. A complaint about GymPad services can be made directly to the Service Provider independently of the store’s refund procedure.

Consumers may seek help from a consumer ombudsman or use an appropriate out-of-court procedure, including through the Polish Trade Inspection, under applicable law. Information is available from UOKiK. Participation in a particular procedure depends on applicable rules and any required party consent.

13. Liability

The Service Provider is liable under applicable law and does not promise outcomes beyond the agreed application features. It is not liable for circumstances for which the law does not hold it responsible, such as User conduct or independent failures of the User’s device or connection, unless caused by the Service Provider’s fault or failure to fulfil its duties. The Service Provider does not guarantee the User’s continuous Internet connection or service availability beyond what the contract and law require. A third-party outage does not automatically remove liability for the Service Provider’s own performance.

Only for a User acting professionally as a business who has neither consumer protection nor the protection afforded to certain individual entrepreneurs, the Service Provider’s aggregate liability for damages connected with GymPad is limited to the greater of PLN 200 or the total fees paid by that User for GymPad access in the 12 months preceding the event causing damage. In those same relationships, liability for lost profits is excluded. These restrictions do not cover intentional misconduct, gross negligence, personal injury or liability that cannot lawfully be restricted, particularly under data protection law. Nor do they limit refunds due.

The above cap and exclusion of lost profits do not apply to consumers or individuals entitled to the relevant consumer protections. Users are responsible for their own unlawful conduct under applicable law; these Terms do not require them to assume all claims against the Service Provider or the costs of its defence.

14. Updates, restrictions and ending services

The Service Provider supplies updates necessary for conformity, including security updates, for the period required by law. Users should install them within a reasonable time. Liability for a lack of conformity caused solely by failure to update may be excluded only on statutory conditions, particularly after notice of the update and the consequences of not installing it, and with correct installation instructions.

A service change beyond maintaining conformity is permitted only for a justified reason: a change in law, store or integration requirements, a security threat, a necessary infrastructure change or feature development consistent with GymPad’s purpose. It cannot impose additional charges for already agreed performance. The Service Provider explains the change clearly; if it materially and negatively affects use, it provides advance notice on a durable medium describing the change, its date and the right to terminate without notice within 30 days of the change or later notification, unless unchanged access remains available at no extra cost. Settlement follows applicable statutory rules.

Where law or these Terms are breached, the Service Provider may impose a proportionate access restriction or terminate the contract. Where possible, it first explains the breach and allows a reasonable time to remedy it. Immediate restriction is permitted where required by law or necessary to address a serious security threat, fraud or a serious infringement of others’ rights. Reasons and reconsideration follow section 10. Lawfully exercising withdrawal, complaint or refund rights is not by itself a breach of these Terms.

Ordinary discontinuation of a service or termination by the Service Provider requires a valid reason, such as cessation of business, permanent technical or legal inability to perform, or repeated material breaches, and at least 30 days’ notice on a durable medium, subject to situations requiring earlier action under law. The Service Provider enables data retrieval to the extent required by law and settles the unused paid period where the service cannot be provided.

Users may stop using the application at any time and end the account contract by deleting their account in settings or contacting the Service Provider. Settlement of paid access depends on the offer and statutory rights. Store subscription renewal must be cancelled separately as explained in section 7.

15. Changes to these Terms, applicable law and contact

These Terms may be amended for the reasons in section 14 or to correct obvious errors or clarify provisions without restricting User rights. New contracts use the version disclosed before they are concluded. For changes affecting an ongoing contract, the Service Provider gives individual notice on a durable medium explaining the changes, reasons and effective date, generally at least 30 days in advance. A shorter period is possible only where law permits and a legal obligation or urgent security threat requires it, without depriving the User of their rights.

Changes are not retroactive, do not remove acquired rights and do not arbitrarily alter a paid offer. Where express agreement is required, continued use does not replace it. Users may reject a change and end the contract under the rules applicable to that change, with statutory settlement and the rights in section 14 preserved.

Polish law governs the contract. This choice does not deprive a consumer of applicable mandatory protections of their country of habitual residence. Court jurisdiction follows applicable law; these Terms do not impose exclusive jurisdiction in the Service Provider’s place of business on a consumer. An ineffective provision is not binding to the extent prescribed by law; the remaining provisions continue if the contract can operate without it.

Contact for GymPad matters: matcode.help@gmail.com. This version applies after it has been made available and validly incorporated into the relevant contract. Updating the document’s date does not automatically amend existing contracts.
